Recently, the wife of an employee of Goldberg Law slipped and fell in a well-known local grocery store. The woman was walking in the store, with wet shoes caused by the rain outside. She took a pretty serious spill, falling face-first and landing on her chest. She suffered a skinned knee, sore ribs and a scrape on her elbow.
And nobody sued the store.
Surprised? Don't be. Not every accident calls for a lawsuit. The woman went to her doctor for examination, and sustained no lasting injuries. The store, much to their credit, reacted immediately after the fall, offering to transport the woman to the hospital to be checked out. The store manager told the woman the store would pay for any of her out-of-pocket medical costs. She completed an incident report, and sent along receipts for her medical examinations to the store's risk management department. Within just a few days, the woman was not only paid back, in cash, for the money she had personally spent, but also a small additional amount. To the store's credit, they acted fast, and fairly.
Of course, these types of slip-and-fall accidents happen all the time, and large grocery chains understand this. Are there cases in which this same grocery store has been faced with a lawsuit because someone took a tumble in their store? Of course there are – and Goldberg Law has been hired by people who were hurt in those types of circumstances. But, it is important to point out that there must be a burden of proof that the store did something – or did not do something – that resulted in the fall to begin with. People are ticked off when they hear about frivolous lawsuits, or lawsuits that they believe have no merit and should never have been filed to begin with. We agree – we are not in business to waste people's time or to go after money that is not rightfully due someone.
