Will COVID 19 Affect My Personal Injury Case?

Posted by Goldberg Noone Abraham | Apr 13, 2020 | 0 Comments

People may assume everything that has transpired within the past couple of months regarding the rapid spread of the COVID 19 virus means finding and hiring a personal injury law firm would be a challenge, if not impossible.

To the contrary, the attorneys, case analysts, paralegals and legal staff at Goldberg Noone Abraham continue to aggressively fight for our clients' rights in seeking financial compensation for their injuries sustained because of the fault of someone else.

Our firm continues to build your case while working within the parameters set forth by Florida's Safer At Home restrictions. Here are some of the things we continue to do every single day on behalf of our clients:

Negotiations: Our attorneys continue to be in aggressively negotiate with insurance companies to move your case forward on your behalf.

Mediation: Our attorneys continue to present your case at mediations, using videoconferencing tools to include the defense attorney, insurance company, and mediator.   We do everything to ensure your voice is heard while we continue to move your case forward.

Depositions: Our firm is conducting depositions using video conferencing to reduce the risk of spreading the coronavirus, and we have moved forward with this process seamlessly.

Court Filings:  Due to the availability of electronic filing, we continue to be able to draft and e-file all Lawsuits, Discovery requests and responses, Motions, Notices and other necessary legal documents with the court, so that we do not miss any important deadlines.

The 20th Judicial Circuit that includes 5 southwest Florida counties has issued an Administrative Order providing further guidance on what are considered essential and non-essential court proceedings. While there are currently no jury trials being conducted, there are still other critical court proceedings taking place while adhering to the Center for Disease Control's and other local social distancing mandates.  Many of the hearings on your cases have been conducted telephonically with the judge on your case.

You can read the entire list and the actual Court administrative order here: https://www.ca.cjis20.org/pdf/ao/ao_2_39.pdf

Discovery: GNA is fully equipped and skilled at continuing to provide necessary discovery materials through the court's e-filing system, like the exchange of discovery materials and filing of any motions we feel are needed regarding your case.

CME – Compulsory Medical Exam: If you've been injured in a crash, your insurance company may request a CME, which is a medical examination conducted by the insurance company's doctor. Due to COVID-19, most of the CMEs are being rescheduled to avoid unnecessary risk of exposure to the virus. Our legal assistants and case analysts stay on top of any requests to schedule exams of this nature to protect your legal rights and your health.

At Goldberg Noone Abraham, Your Case is NOT “On Hold”

Even though some court activities may be postponed, we continue to work on our clients' cases to ensure your injury claim is progressing forward with essential work necessary to continue to fight for your right to fair compensation.

If you have recently been injured because of someone else's negligence, you do not need to wait to contact the attorneys at GNA to begin the process of seeking justice. New clients never need to leave their home and can begin the process of retaining our law firm with just a phone call to 239-461-5508. All paperwork can be sent and returned electronically, and you will not need to physically meet with a GNA attorney until it is safe to do so.
