“Accident Surcharge”? There is Nothing Fine about Fine Print
Few people actually take the time to read all the information given to them when they buy car insurance. The agent will go over the basics of your coverage, and give you a bunch of paperwork to ‘review later'.
But one of our employees at Goldberg, Racila, D'Alessandro & Noone personal injury law firm recently renewed their car insurance policy, and then received some interesting paperwork in the mail.
Goldberg Law has posted a lot of blogs about exactly what can happen between you and your insurance company in the event you are involved in an auto accident. Our experience has found that in so many cases, even after faithfully paying your premiums every month, your carrier will not be anxious to pay for any damages or physical injuries. In fact, the giant insurance companies and their attorneys will go out of their way to delay, divert or even deny your legitimate accident claim. You can read more from our attorneys on that topic here.
The employee received the printed notification seen here regarding ‘increased premiums resulting from accidents'. It came in an envelope full of policy information, stuck inside as a little flyer. Many people – in fact, we would estimate most people – would not take the time to even read it, thinking it was probably some promotional offer.
The flyer goes into great detail about how the insured may face being charged an ‘accident surcharge' if involved in a car, truck or motorcycle crash. There are 2 sections – 1 covers the insured vehicle, and 1 covers the insured driver. There are 11 stipulations relating to how you will be billed for an ‘accident surcharge', and the things you need to do in order to be reimbursed for those charges. Note that your insurance carrier will bill you for the fee – then, it becomes your responsibility to prove why you should get your money back.
If you're beginning to see why retaining an experienced personal injury attorney to help you through the hassle of dealing with the aftermath of a serious auto accident, you're getting the picture.
Essentially, the insurance company is letting you know that if you get in a crash, it will fall on you to demonstrate why you should not be charged any type of accident surcharge. They are providing this information to you when you get your policy in the mail, whether you've been involved in an accident, or not.
Imagine dealing with them after a crash in which you've suffered some serious physical injury?
“Insurance companies and the agents who work for them do a great job at selling their policies, and trying to assure the policyholder that everything will be OK if they're involved in an accident”, says Fort Myers personal injury attorney Ray Racila. “But the reality is, getting them to pay a legitimate claim after a crash involving extensive medical bills and severe physical trauma to their insured can become a nightmare, and quickly”.
The Southwest Florida personal injury law firm of Goldberg, Racila, D'Alessandro & Noone has over 90+ years of combined experience helping people who have been hurt through no fault of their own. The attorneys, adjustors and claims investigators who represent your insurance company will demonstrate every aggressive tactic in the book to see to it that your claim is questioned, run through their computer software programs, (used to supposedly determine the ‘value' of your claim), and generally set up countless roadblocks on your way to settling. Without the help of a lawyer who handles these types of negotiations every day, you risk having your claim denied completely.
