Dangerous Product: CPSC Announces Recall of Children’s Toys

On Friday, April 12th, the Consumer Product Safety Commission announced a recall by six major retailers of two potentially dangerous toy products. The toys, known as Buckyballs and Buckycubes are high-powered magnets which are small enough to become ingested, and can cause a serious choking hazard.

The small toy magnet sets were being sold at Barnes & Noble, Bed Bath & Beyond, Brookstone, Hallmark, Marbles The Brain Store and Thinkgeek retail outlets.

In most defective product recalls, the manufacturer willingly recalls the product, and cooperates with the CSPC to ensure the safety of those who have purchased the item. However, in the case of Buckyballs and Buckycubes, the CPSC issued an administrative complaint against Maxfield & Oberton Holdings LLC, of New York, N.Y., after talks to negotiate a voluntary manufacturer recall were unsuccessful.

This type of legal action against a company is rare, as the CPSC has filed only four administrative complaints in the past 11 years. There have been 54 reported incidents of children and teens ingesting this product, with 53 of them requiring medical interventions.

“People need to exercise extreme caution when selecting toys for their children”, notes Fort Myers defective product lawyer Michael M. Noone, of Goldberg, Racila, D'Alessandro & Noone, LLC. “With more than 3 million sets of these dangerous toys having been sold, there is a great risk for a potentially serious choking hazard.”
