Being involved in a personal injury lawsuit means understanding many confusing legal terms
The shock of being involved in a serious car or motorcycle accident makes you confused, scared and unsure of what will happen next. Your whole world has been turned upside down, and you don't know who to turn to for answers to the hundreds of questions you'll have.
When you hire a personal injury law firm in Fort Myers, it doesn't necessarily mean you'll be involved in an actual lawsuit. In the majority of our cases, we are able to successfully negotiate with the insurance companies involved to come to a successful financial settlement to compensate you for your injuries, property damages, lost wages and other items. In the course of going through that long and complicated process, there are a host of situations that may come into play in an effort to settle your case.
In the event that our attorneys and the insurance company cannot come to an agreement, there are two possible scenarios that may be an important step in resolving your case. These two proceedings are called arbitration and mediation. In some cases, they may be ordered by the court. In other instances, both sides may agree to use one of these methods to try to avoid a costly court trial.
Although they are somewhat similar, let's take a closer look at what these two procedures involve:
Arbitration is a proceeding in which the parties present their cases to one or more arbitrators, who then make a decision which can either be binding (the final decision by which the parties must abide) or non-binding (a suggestion for what the arbitrator(s) believe to be a fair resolution to the case).
Mediation is an informal settlement conference at which the parties and their attorneys present their positions to a neutral individual (the mediator). That mediator then speaks to the parties separately, in an effort to bring them to an agreement to settle the matter.
The attorneys at Goldberg Noone law firm are extremely adept at personally counseling all of our clients on the many steps involved in their case, and we keep you fully informed every step of the way. If you end up being involved in an arbitration or mediation, we'll sit down with you just before it has been scheduled to review exactly what is going to happen, so you know exactly what to expect. Again, you'll likely be very confused and uncertain after being in a serious crash, and the last thing you need is more legal jargon to add to your confusion.
We use everyday language to thoroughly explain each and every aspect of what you'll be going through.
There are many legal terms that come into play in the course of negotiation with the insurance companies, or if you do end up going to trial. You can read more about them here.
