BREAKING LEGAL NEWS: Woman Falls in Grocery Store; Nobody Gets Sued!

Goldberg Law

When it comes to the world of personal injury law, there are many people out there who have misconceptions.

Let's be honest here – many people don't like lawyers, and much of that distaste is directed specifically at lawyers who practice personal injury law. There is a feeling that lawyers are responsible for more laws and regulations, gumming up the court system just to line their own pockets.

Until you actually speak to a personal injury attorney about why they do what they do, it may be easy to assume those things are true. Many people have had a bad past experience involving an attorney, and end up disliking and distrusting them all as a whole.

In reality, good personal injury lawyers – and there are many in Southwest Florida – do what they do for one specific reason; to help make someone who has suffered a serious injury, through no fault of their own, whole again after an accident.

“I've heard all the lawyer jokes, and yes, I do laugh at them, too”, points out Fort Myers personal injury attorney Scot D. Goldberg of the Goldberg Law Firm. “But our firm has a long history of helping people who have found themselves seriously hurt because of someone else's negligence, carelessness or both. I sincerely get up every morning with the mission of helping people, and anyone who knows me understands that”. (The firm also has a long list of satisfied clients – you can read what they have to say here.)

SHOCKING! Not Every Slip & Fall Accident Results in a Lawsuit

Recently, the wife of an employee of Goldberg Law slipped and fell in a well-known local grocery store. The woman was walking in the store, with wet shoes caused by the rain outside. She took a pretty serious spill, falling face-first and landing on her chest. She suffered a skinned knee, sore ribs and a scrape on her elbow.

 And nobody sued the store.

Surprised?  Don't be. Not every accident calls for a lawsuit. The woman went to her doctor for examination, and sustained no lasting injuries. The store, much to their credit, reacted immediately after the fall, offering to transport the woman to the hospital to be checked out. The store manager told the woman the store would pay for any of her out-of-pocket medical costs. She completed an incident report, and sent along receipts for her medical examinations to the store's risk management department. Within just a few days, the woman was not only paid back, in cash, for the money she had personally spent, but also a small additional amount. To the store's credit, they acted fast, and fairly.

Of course, these types of slip-and-fall accidents happen all the time, and large grocery chains understand this. Are there cases in which this same grocery store has been faced with a lawsuit because someone took a tumble in their store? Of course there are – and Goldberg Law has been hired by people who were hurt in those types of circumstances. But, it is important to point out that there must be a burden of proof that the store did something – or did not do something – that resulted in the fall to begin with. People are ticked off when they hear about frivolous lawsuits, or lawsuits that they believe have no merit and should never have been filed to begin with. We agree – we are not in business to waste people's time or to go after money that is not rightfully due someone.

But if someone is hurt and their injuries were serious and the fault of the store, a skilled personal injury lawyer can be a valuable advocate in helping them get their life back together.

Again, the bottom line is not every slip-and-fall warrants suing a store in which it occurred. Yes, that may come as a shock to some ‘attorney-haters' out there, but it's true.

If you have taken a fall in any type of slip-and-fall accident, we invite you to give us a call to discuss your situation. We may be able to help, or we may tell you we feel your situation is one where there are no real grounds for a lawsuit. That type of candidness is how the Goldberg Law Firm has remained in business for so long.
